How compliant is that cookie in the window?

The Dutch Data Protection Authority (AP) carried out a check on approximately 175 websites of web shops, municipalities and media, among other things, to determine whether they met the requirements for placing tracking cookies.

Almost half of the websites that use tracking cookies did not meet the permission requirements. The organizations behind these websites have received a letter from the AP calling on them to adjust their settings if necessary. In the near future, the AP will start an investigation into whether cookies are used lawfully. Not allowed:

  • pre-checked checkbox
  • silence, inactivity or scrolling down
  • variations on “you agree if you continue on this website”
  • cookie walls (giving visitors access to their site only if they agree to place tracking cookies or other similar ways of tracking)
